Terms of Service

These terms are an agreement between you and [LLC legal name] (“Stackowl”, “we”, “us”) for using the Stackowl website at thestackowl.com and the Stackowl apps (together, “Stackowl”). By creating an account or using Stackowl, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Stackowl.

1. What Stackowl is, and isn’t

Stackowl helps you plan your money one paycheck at a time, using the information you enter. It is a planning tool, not financial, tax, legal or investment advice. Stackowl doesn’t connect to your bank, move money or pay bills. Its figures are only as accurate as what you enter, so check important decisions against your actual accounts. You’re responsible for your own financial decisions.

2. Your account

• You must be at least 13 (or the minimum age where you live) to use Stackowl, and old enough to agree to these terms or have a parent or guardian’s permission.
• Give accurate sign-up information and keep your password safe. You’re responsible for what happens under your account; tell us straight away through our contact form if you think someone else has used it.
• Households: if you invite someone to your household, they can see and change your shared budget, and so can you theirs. Invite only people you trust. The household’s owner can remove members.

3. Your information

What you enter stays yours. You give us permission to store, process and display it only to run Stackowl for you and your household, as the Privacy Policy describes. You can delete it at any time.

4. Acceptable use

Don’t:

• break the law using Stackowl, or use it to harm anyone;
• try to get into accounts or data that aren’t yours, or get around our security;
• overload, disrupt, scrape or reverse-engineer Stackowl, or use automated tools to access it, except as the law allows;
• resell Stackowl or pretend to be us.

We may suspend or close accounts that break these rules, and we’ll tell you why unless the law or safety stops us.

5. Price

Stackowl is currently free. If we introduce paid features, we’ll tell you the price and terms first, and you won’t be charged unless you choose them. Purchases in the apps are handled by Apple or Google under their terms.

6. Changes and availability

We’re always improving Stackowl, so features may change, and we may pause or end parts of it. We’ll give you reasonable notice before ending the service, and time to get a copy of your information. We work to keep Stackowl running, but can’t promise it will always be available or free of errors, so keep your own records of anything important.

7. Ownership

Stackowl’s software, design, name and owl logo belong to us. We give you a personal, non-transferable right to use Stackowl under these terms. If you send us feedback, we may use it freely.

8. Disclaimers

Stackowl is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we don’t promise that Stackowl’s figures are accurate, complete or on time.

9. Limits on liability

To the fullest extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost money, profits or data, including late fees, overdrafts or missed payments, arising from your use of Stackowl. Our total liability for any claim about Stackowl is limited to the greater of what you paid us in the 12 months before the claim or US $50. Some places don’t allow these limits, so they may not all apply to you.

10. Indemnity

If someone brings a claim against us because you broke these terms or the law, you agree to cover our reasonable costs for it, to the extent the law allows.

11. Ending your use

You can stop using Stackowl and delete your account at any time, in the app or on the website. We may end these terms or your access if you break them. Sections 7 to 12 continue after that.

12. Disputes and law

These terms are governed by the laws of [State], USA, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it. Disputes will be handled in the state or federal courts of [County, State], unless the law where you live gives you the right to bring them elsewhere.

13. App stores

If you downloaded Stackowl from Apple’s App Store or Google Play, these terms are between you and us, not Apple or Google, and those stores’ own terms also apply. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the app.

14. Changes to these terms

We may update these terms. We’ll change the effective date, and for important changes, tell you in the app or by email before they take effect. If you keep using Stackowl after that, you accept the new terms.
